Custom ISO SSHD fails to start

Custom ISO SSHD fails to start

I have build a customised sysrescueCD from version 4.4.1 with some boot options added such as rootpass and setkmap.
When booted SSHD status shows stopped.
Starting SSHD service fails reporting that /var/empty has world and group access which it should not.
It looks like the customisation steps are changing permissions. Is this a known problem?
